Overview of FSSAI Registration

FSSAI Registration/License is a food safety and standards authority of India established under the Ministry of Health & Family Welfare, Government of India. This authority provides food licenses to every food business in India after which food businesses must follow FSSAI rules and regulations for maintaining food qualities or its various parameters. FSSAI is responsible for protecting and promoting public health through the regulation and supervision of food safety. Types of FSSAI License

Different Types of FSSAI License
Basic FSSAI Registration/License:

If annual turnover of any food business operator is less than 12 Lakh, then basic FSSAI license is enough. This can be upgraded to state/central license in case of increase in turnover. Dairy having capacity less than 500 litres per day or daily manufacturing capacity less than 100kg per day needs to get basic FSSAI registration. This is for small size food businesses. This license is applicable for maximum 5 years and minimum 1 year.

State FSSAI Registration/License:

If annual turnover is more than 12 Lakhs and less than 20 crores must obtain state FSSAI license. This can be upgraded to central license in case of increase in turnover. Manufacturing units having capacity up to 2 MT per day, Dairy units handling business up to 50000 litres per day, 3-star hotels need to get State FSSAI license. This is for medium size food businesses. This license is applicable for maximum 5 years and minimum 1 year.

Central FSSAI Registration/License:

If annual turnover is more than 20 crores must obtain a state FSSAI license. If a food business provider is not falling in any of the above two categories, then they must apply for a central FSSAI license. This is for big size food businesses. This license is applicable for maximum 5 years and minimum 1 year.

Registration Process

Steps to Register for FSSAI
  1. Fill our FSSAI Registration form online
  2. Fill Form A/B with the government and make declaration mentioned therein. Application will be accepted/rejected within 7 days.
  3. Government will scrutinise the paper & forms and respond to the queries if any raised by government.
  4. Apply for TAN and PAN of the Partnership firm. Government will issue FSSAI license within 45-60 days if paper & forms are fine.

Non-Compliance

Consequences of Non-Compliance

Food business providers must comply with the rules and regulations of FSSAI failing to which can attract heavy penalties. FSSAI can conduct random investigations of the product and can inspect the working condition of the premises. Society must comply with various mandatory compliances if not complied can attract several heavy penalties and can lead to cancellation of license also. Based upon the compliance level, food safety officers will mark it as:

  • Compliance (C)
  • Non-compliance (NC)
  • Partial compliance (PC)
  • Not applicable/Not observed (NA)

Based on the above categories of compliance, officers may issue an improvement notice failing to which lead to cancellation of FSSAI license. Aggrieved food operators can appeal to the state commissioner of food safety. Further, this decision can be challenged by appealing to the Food Safety Appellate Tribunal or the high court.

Penalty for Non-Compliance

Penalties for Violations
  • If running business without FSSAI license - Imprisonment and fine up to 5 Lakhs
  • Selling sub-standard quality of food items - fine up to 5 Lakhs
  • Selling misbranded goods - fine up to 3 Lakhs
  • Misleading Advertisement - fine up to 10 Lakhs
  • Failure to comply with food safety officer direction - fine up to 2 Lakhs
  • Unhygienic Manufacture - fine up to 1 Lakhs
