Provisional Patent Filing in India

Secure Your Innovation Before Going Public

A Provisional Patent Application is a temporary and initial step toward securing a patent for your invention. It allows inventors to establish an early filing (priority) date for their innovation, even before the final version of the invention is fully developed.

This application is filed with the Indian Patent Office under the Indian Patents Act, 1970, and must be followed by a complete specification within 12 months.

Key Features:
Locks your priority date: Helps you protect your idea from being copied or claimed by others.
Simpler than full patents: Requires a technical description but no detailed claims.
Cost-effective & quicker: Ideal when you want fast protection before market launch or R&D completion.
Gives "Patent Pending" status: You can use this status for product labeling, marketing, or investor engagement.

When to File a Provisional Patent?

You have a concept or working prototype, but the invention is still under development.
You want to establish an early priority date.
You need time to conduct market research or attract investors.
You want to prevent competitors from filing similar patents.

It protects your invention idea as disclosed in the provisional specification. While it does not grant patent rights, it reserves your place in line at the Patent Office.

If a complete specification is not filed within 12 months, the provisional application lapses.

Step-by-Step Process

Step 1: Consultation & Evaluation

Our experts evaluate your invention for patentability and novelty.

Step 2: Drafting the Provisional Specification

We prepare a technical document describing the invention — including problem solved, features, drawings (if any), and its utility.

Step 3: Filing with the Indian Patent Office

The provisional patent application is filed electronically with Form-2 and other required details.

Step 4: Patent Pending Status

Once filed, your invention gets a "Patent Pending" status, which can be used in documents, marketing, and investor pitches.

Step 5: File Complete Specification

You must file a complete patent application (Form-1 and full description) within 12 months to continue the patent process.
